We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. Endothelial cells line the inside of all blood vessels, forming a structurally and functionally heterogenous population of cells. Their complexity and diversity has long been recognized, yet very little is known about the molecules and regulatory mechanisms that mediate the heterogeneity of different endothelial cell populations. The constitutive organ‐ and microenvironment‐specific phenotype of endothelial cells controls internal body compartmentation, regulating the trafficking of circulating cells to distinct vascular beds. In contrast, surface molecules associated with the activated cytokine‐inducible endothelial phenotype play (...) a critical role in pathological conditions including inflammation, tumor angiogenesis, and wound healing. Differentiation of the endothelial cell phenotypes appears to follow similar mechanisms to the differentiation of hematopoietic cells, with the exception that endothelial cells maintain transdifferentiating competence. The present review offers a scheme of endothelial cell differentially expressed endothelial cell molecules as targets for directed therapeutic intervention. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

This essay evaluates two arguments found in John Morreall’s Taking Laughter Seriously: That Christianity is incompatible with a sense of humor since the latter requires that a person take nothing with absolute seriousness, and that God can have no sense of humor because he is omniscient. I point out that seriousness about something is a necessary condition of humor and that what people find funny is in part a function of what they take seriously. I illustrate these points with examples (...) from Samuel Johnson and SorenKierkegaard. Then I show how ultimate seriousness is compatible with a sense of humor, by appeal to Kierkegaard’s notion of a “way out” of responsibility for the object of one’s seriousness. Here I illustrate with St. Francis of Assisi, William James, and Kierkegaard.Morreall’s claim that God’s omniscience rules out his having a sense of humor turns on the thesis, fundamental to his book, that humor depends on “psychological shift,” which he mistakenly identifies with surprise. I distinguish these concepts, show that humor should not be construed even in terms of the (weaker) concept of psychological shift, and suggest a way of understanding God’s omniscience such that it is compatible with his sense of humor. Cells fine‐tune their DNA repair, selecting some regions of the genome in preference to others. In the paradigm case, excision of UV‐induced pyrimidine dimers in mammalian cells, repair is concentrated in transcribed genes, especially in the transcribed strand. This is due both to chromatin structure being looser in transcribing domains, allowing more rapid repair, and to repair enzymes being coupled to RNA polymerases stalled at damage sites; possibly other factors are also involved. Some repair‐defective diseases may involve repair‐transcription coupling: three (...) candidate genes have been suggested.However, preferential excision of pyrimidine dimers is not uniformly linked to transcription. In mammals it varies with species, and with cell differentiation. In Drosophila embryo cells it is absent, and in yeast, the determining factor is nucleosome stability rather than transcription.Repair of other damage departs further from the paradigm, even in some UV‐mimetic lesions. No selectivity is known for repair of the very frequent minor forms of base damage. And the most interesting consequence of selective repair, selective mutagenesis, normally occurs for UV‐induced, but not for spontaneous mutations. The temptation to extrapolate from mammalian UV repair should be resisted. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

This book presents translations of three dialogues Xenophon devoted to the life and thought of his teacher, Socrates. Each is accompanied by notes and an interpretative essay that will introduce new readers to Xenophon and foster further reflection in those familiar with his writing. "Apology of Socrates to the Jury" shows how Socrates conducted himself when he was tried on the capital charge of not believing in the city's gods and corrupting the young. Although Socrates did not secure his own (...) acquittal, he profoundly impressed some listeners who then helped to shape the public perception of philosophy as a noble, if highly idiosyncratic, way of life. In "Oeconomicus," Xenophon relates the conversation Socrates had on the day he turned from the study of natural philosophy to that of moral and political matters. The Greek philosopher Aristotle, writing over two thousand years before Wall Street, called people who engaged in activities which did not contribute to society "parasites." In his latest work, renowned scholar Robert C. Solomon asserts that though capitalism may require capital, but it does not require, much less should it be defined by the parasites it inevitably attracts. Capitalism has succeeded not with brute strength or because it has made people rich, but because it has produced responsible citizens and--however (...) unevenly--prosperous communities. It cannot tolerate a conception of business that focuses solely on income and vulgarity while ignoring traditional virtues of responsibility, community, and integrity. The last half of Leviathan is designed to refute these claims in detail, and this refutation is not merely tacked onto the first parts but is a logical extension of them. The argument for escaping the state of nature is that only through obedience to a (...) common power can man escape the likelihood of an early death. Once that common power is established, and so long as it can carry out its protective function, obedience to it is obligatory. When a man enters civil society, the only right he retains is to defend himself against physical death, and consequently, the only time he is entitled to disobey the sovereign is when the sovereign directly threatens him. Thus excuses for rebellion are reduced to an absolute minimum. In McNeiily's formalization however, the concept of a man's death must be replaced by the formal concept of the frustration of all one's desires. And so "whatevvr [a man] regards as the complete frustration of all his desires... he will be entitled to resist, even if such resistance puts him at war with others, including lawful authority" (p. 193). Now the incredible range of things men have believed essential to avoiding the frustration of all their desires is amply testified to in the history of religious warfare. And clearly, under this formalized interpretation, men would be entitled to rebel over the form of baptism, church government, ministerial costume, prayer, or anything else if they are convinced it is essential to their salvation. It takes little knowledge of history to see that Hobbes's espousing of a theory with such consequences has a low degree of probability indeed. Hobbes complains in Leviathan of Scriptural exegetes who "by casting atoms of Scripture, as dust before men's eyes, make everything more obscure than it is." Rather, he claims, it is "not bare words, but the scope of the writer, that giveth the true light by which any writing is to be interpreted; and they that insist upon single texts, without considering the main design, can derive nothing from them clearly'" (E. W., III, 602). This last would be too harsh to apply to McNeiity's work generally, for his "atoms" are for the most part of considerable worth in themselves. DO WE CHOOSE OUR EMOTIONS? Can we be held responsible for our anger? for feeling jealousy? for falling in love or succumbing to resentment or hatred? The suggestion sounds odd because emotions are typically considered occurrences that happen to us: emotions are taken to be the hallmark of the irrational and the disruptive. Controlling one’s emotion is supposed to be like the caging and taming of a wild beast, the suppression and sublimation of a Freudian "it.".

This article examines the arguments used by Robert Watts, a contemporary of John Stuart Mill, in his criticism of Mill's Utilitarianism. The pamphlet in which Watts expresses his views is a scarce and neglected work. Pioneering studies by J.C. Rees and J.B. Schneewind emphasize the importance of Mill's early critics for historians of nineteenth-century ethics and politial thought. Rees, however, confines his study to the responses to Mill's On Liberty. Schneewind's work is more comprehensive and does mention Watts, but (...) without examining in detail the actual arguments that Watts uses. Further, while Watts criticizes Mill's ethical views from a theological standpoint the arguments he uses are philosophical in character. Watts should not be thought of as a major philosophical critic of Mill, but his relative neglect leaves a gap in the study of the reception of Mill's thought which this article is intended to fill. Not Passion's Slave is a collection of Solomon's most significant essay-length publications on the nature of emotions over the past twenty-five years.
